Kathmandu. The consumer court has decided to pay a total compensation of Rs 25.9 million to three big hospitals and doctors involved in the case of negligence in treatment within a month.
The court also imposed a fine against Grandi City at Kantipath, Om Hospital at Chabahil and Himal Hospital, Dillibazar.
In its verdict on July 17, the court has ordered the Hospital and the doctors to pay Rs 5.719 million as compensation to The Grandi City Hospital for negligence in treatment. Earlier, the court had ordered himal hospital and doctors to pay Rs 14.5 million as compensation and Rs 5.07 million to Om Hospital and doctors.
Under the Consumer Protection Act, 2075 BS, the aggrieved party can seek compensation and legal punishment through the consumer court against negligence in treatment.
Case 1:
The court had on June 26 awarded rs 5.68 million as compensation from Om Hospital and doctors in a case filed by his son Basanta Gautam alleging negligence in the treatment of Harihar Prasad Gautam. A division bench comprising Ram Prasad Sharma, Gehendra Raj Regmi and Ananda Raj Pokharel passed the order on June 12. The court has ordered the hospital to pay 80 percent compensation and two doctors involved in the treatment will have to pay 20 percent compensation at the rate of Rs 305,000.
Basanta Gautam had filed a case with the Consumer Court demanding Rs 50 million in damages, claiming that his father was negligent in treatment. Harihar Prasad, 98, was admitted to the emergency room of Om Hospital on January 1, 2081 after he fell into a bath and was injured. Doctors working in the emergency had prescribed some medicines after a general check-up and gave injections to reduce X-ray pain.
Even after four days of discharge, the pain did not subside and he was taken to another hospital for treatment. Basanta Gautam had filed a case seeking compensation for the death of his father due to other health risks due to negligence without proper treatment.
case 2:
In another case, the consumer court ordered himal hospital pvt ltd and the doctors involved in the treatment to pay Rs 14.5 million as compensation for the death of the sick child due to negligence in treatment. A joint bench of Ram Prasad Sharma, Gehendra Raj Regmi and Ananda Raj Pokharel on July 27 decided to pay 70 per cent compensation to the hospital and 30 per cent to Dr Jayadev Yadav.
Out of this amount, the hospital has to pay Rs 10.18 million and the doctors Rs 4.36 3 million.
Ganga Gautam had lodged a complaint with the Nepal Medical Council (NMC) alleging negligence in treatment of her 28-month-old daughter Prasansha. The council had decided to issue a warning to the doctors involved in the treatment. Pediatrician Dr. It was decided to warn Jayadev Yadav to take proper precautions while using quality treatment methods and sending them.
The case filed by the girl’s parents at the District Court, Kathmandu, was transferred to the Consumer Court in March last year after the council decided to issue only a warning.
case 3:
Hearing another case, a division bench of Consumer Court Chairman Ram Prasad Sharma and members Gehendra Raj Regmi and AnandRaj Pokharel on June 17 ordered grandi city hospital and doctors involved in the treatment to pay Rs 5.719 million as compensation.
Barsha Bhandari had filed a case on March 27, claiming compensation of Rs 31.7 million for negligence in her treatment. Considering the relative liability of negligence, the court has decided to pay a compensation of Rs 5.7million.
According to the court’s verdict, 70 percent of the compensation amount i.e. Rs 4 million 3 thousand 300 was given to Dr. Sanjeev Tripathi and Grandi Hospital will have to bear 30 percent i.e. Rs 1,715,700.
Plastic surgery was performed after removing the fat in the leg of the rain after the back of the thigh of the leg caused pain. According to the case filed by Varsha, the doctor had performed two surgeries, but instead of recovering, she had filed a case seeking compensation.
If the consumer is not satisfied with the court’s decision, the hospital, the doctor or even the victim’s guardian can file an appeal petition in the Patan High Court.
