Delhi court orders insurance claims to be paid in case of death while driving

Kathmandu. The Delhi High Court of India has issued a landmark order in favour of the insured.

The court has ordered the insurance companies to pay the insurance claim not only in road accident but also in case of murder by an unknown group while driving. The High Court’s verdict comes in the wake of a recent case in which a truck driver was murdered while driving.

A single bench of High Court Judge Manoj Kumar Ohri ruled that the insurance companies should pay the claim only if there is no conspiracy or personal reason to kill the vehicle. “If the death is due to personal reasons while driving, the insurance company will not be obliged to pay the claim,” the order reads, “If an unknown group kills the person while driving, then the victim’s family will be entitled to the insurance claim.” ’

According to the insurance company, the claim of the driver, the victim’s family and the vehicle will be paid only in case of death or injury due to the negligence of the second vehicle in a road accident. However, the Delhi court has completely rejected this claim of the insurer. “The family cannot be left at the mercy of God when the driver was killed while driving,” the court said. ’

In this incident, the driver was driving the truck during night duty. His insurance policy was also valid. Suddenly, an unknown group attacked him as a robber and he died on the spot. The case reached the court after the victim’s family refused to pay the claim when they approached the company for the insurance claim. –Agency
