Supreme Court orders ruling party’s plan to appoint 65-year-olds as governor

Kathmandu. Kathmandu: The Supreme Court (SC) has upheld the order issued by the Ministry of Finance not to implement the amendment to the ‘Criteria related to appointment and nomination of office-bearers and members of public bodies related to the Ministry of Finance, 2073 BS’.

Justices Til Prasad Shrestha and Bal Krishna Dhakal of the Supreme Court on Wednesday upheld the interim order issued earlier not to implement the revised provision of the standards. With this order, the government will no longer be able to appoint a person above the age of 65 years to the post of chairman or member of a public body. He will not be able to be appointed as the governor of Nepal Rastra Bank.

A division bench of Justice Nityananda Pandey issued the order on Wednesday on a writ petition filed by advocate Bishal Thapa.

The Supreme Court (SC) has asked the government not to implement the amendment to the criteria for appointing office-bearers and members above the age of 65 years in public bodies for the time being. At the time of the process of appointment of the governor, the Ministry of Finance had amended the criteria and made a provision to appoint those who have reached the age of 65 years.

Nepal Rastra Bank, Securities Board of Nepal, Nepal Insurance Authority and other 15 institutions are under the public bodies affiliated to the Ministry of Finance. There is a provision to appoint executive chiefs from the Council of Ministers in all these institutions. There was criticism that the amendment was made to pave the way for the appointment of a former administrator close to the CPN-UML in the appointment of the Governor of the Rastra Bank.
