Kathmandu. The District Administration Office has declared various places in Kathmandu as prohibited areas for two months.
The Kathmandu Administration has issued a notification declaring the prohibited areas as prohibited areas in accordance with Sub-section (3A) of Section 6 of the Local Administration Act, 2028. The order issued by the Chief District Officer of Kathmandu District states that the offices of the executive, legislature and judiciary, residences of highly distinguished individuals and the main administrative center and the surrounding areas are prohibited areas, considering the possibility of disorderly and unwanted activities such as vandalism, arson, etc. by agitated crowds while organizing protest programs including hunger strikes, sit-ins, gheraos, processions, demonstrations and meetings, and the possibility of mutual clashes, clashes and riots or unrest, which could seriously affect essential services, public service delivery, public transport, public property and overall peace and security. The administration has stated that the recommendation of the Kathmandu District Security Committee has been taken into consideration, as well as international practice and previous court orders and decisions.
The order prohibits the gathering of more than 5 people in those areas for a period of 2 months, effective from Falgun 25. The local administration has stated that in places other than the areas where the prohibition order has been issued, every citizen has the right to freedom of thought and expression and to assemble peacefully and without weapons and participate in protest programs as per the Constitution of Nepal.
If any damage or loss occurs to government, public and personal property due to the protest programs conducted in exercise of the rights granted by the Constitution and prevailing laws, the administration has stated that the damage will be assessed in accordance with the Local Administration Act 2028 and the Procedure for Assessment of Damage Caused by Public Demonstrations, Strikes and Protest Programs, 2081, and the amount for such compensation will be recovered from the organizer.
