Writ petition filed against Governor Poudel in Supreme Court

Kathmandu. A writ petition has been filed in the Supreme Court against Governor Bishwanath Poudel on Tuesday.

Advocates Ananta Raj Luitel, Bishal Thapa and Pratibha Upreti have filed a writ petition at the Supreme Court seeking cancellation of Poudel’s appointment. The writ petition was filed with the Supreme Court on Friday.

According to the provisions of the Nepal Rastra Bank Act, 2058 BS, a person with no expertise has been appointed as the governor despite having mandatory expertise for the appointment of the governor. According to the writ petition, Poudel was a political personality and had resigned from the committee to become the governor when he himself was a member of the governor’s recommendation committee. “Therefore, the decision to recommend, appoint and administer oath to Poudel as governor is illegal,” reads the writ petition.

Similarly, according to Article 133 (2) and (3) of the Constitution of Nepal, a mixed mandamus order has been issued prohibiting the government from carrying out any far-reaching work in the capacity of governor on matters of serious national importance, including signing of notes.

The writ petition against Governor Poudel has been fixed for Wednesday.
