Kathmandu. It has been found that the defendant’s position is in the property worth crores of rupees that have been ordered to be confiscated by the court. This has made it clear that the government has become helpless.
The Auditor General presented the fiscal year 2080 to President Ram Chandra Poudel today. This has been pointed out in the 62nd annual report of 1981. According to the report, the defendants have so far been using the properties that have been confiscated by the court. The report has suggested to implement the provision of confiscating such properties and selling them for auction or using them by the government itself.
Section 17 of the Criminal Property and Vehicles (Prevention and Confiscation) Act, 2070 states that the property or vehicles deemed to be confiscated by the court should be auctioned or used by the Government of Nepal after the court’s decision or order is final. According to the details provided by the Department of Criminal Property Management, the court has ordered confiscation of undisclosed land of 36 defendants in different districts, shares worth Rs 6.5 million and increased amount, cash reserves of Rs 5.135 million in 17 banks and interest.
However, so far the defendants have been found to be using these properties, the report said. According to the provisions of the Act, the report has suggested to implement the provision of auctioning and selling these properties or using them by the government.
