KATHMANDU: The Patan High Court has issued an interim order in the name of Nepal Insurance Authority (NIA) to suspend the order of suspension of the Board of Directors and Chief Executive Officer of Himalayan Life Insurance. <\/p>\n
A single bench of Judge Kedar Prasad Adhikari on Thursday issued the interim order against the decision to suspend directors Bibek Kumar Shah, Laxman Gyawali, Rajiv Prasad Pyakurel, Ashish Dhakal, Saurav Dugar, Sachin Acharya, Pramila KC and Digamba Jha as well as Chief Executive Officer Kapil Kumar Dahal. The writ petition was filed at the High Court on behalf of suspended director Laxman Gyawali. <\/p>\n
The High Court Patan summoned both the parties on September 30 to discuss the matter. In the writ petition filed on behalf of the petitioner, the Authority had filed a writ petition on June 15. It was sought to quash the direction issued by the Authority and stay the interim order till the disposal of the writ petition. Regarding the cancellation of the direction issued by the Authority, the High Court will now issue an order after the written reply and hearing on behalf of the Authority. <\/p>\n
After the charge sheet was filed against the accused at the Kathmandu District Court, the Insurance Authority had issued an order to suspend the accused after taking cognizance of the matter related to the charge as per the provisions of the Securities Act, 2063. <\/p>\n
In the writ petition, it was sought to issue an impugned order against the authority. A writ petition is filed in the High Court or the Supreme Court on behalf of the aggrieved party or the concerned seeking quashing of the order which has exceeded the jurisdiction of the competent government body.<\/p>\n","protected":false},"excerpt":{"rendered":"
