Kathmandu. In view of the increasing fraud in motor accident insurance claims, the Supreme Court of India has directed all states to form Special Investigation Teams (SITs). <\/p>\n
The apex court also directed the insurance companies to refer all fraudulent insurance claims to the SIT of the respective state for investigation. In its order on August 17, a bench of Justices Hasanuddin Amanullah and PB Warle warned that the top management of the insurance companies concerned will be liable if they make recommendations for dubious claims for investigation. <\/p>\n
The case began with a dispute over whether the vehicle involved in the accident was correctly identified. During the hearing, the court exposed the broad pattern of the same vehicle allegedly involved in multiple accidents and fraudulent insurance claims. Directing the investigation of such claims, the Supreme Court described it as a fraud on a “very large scale” and expanded the scope of the case. <\/p>\n
The bench said that fraudulent claims can not only impose a financial burden on the insurance companies but also affect the real insured. Fraudulent claims can increase the cost of insurance companies. As a result, honest customers are forced to pay higher premiums. <\/p>\n
The Supreme Court has directed all states to form an adequate staff SIT and expedite the investigation of complaints received from insurance companies. <\/p>\n
The apex court also ordered the states to disclose the procedures adopted to investigate such complaints.
